General Terms and Conditions (GTC) of FlexGenFit

 

1. Scope of application

(a) These General Terms and Conditions (GTC) apply to all services and products offered by FlexGenFit, including memberships, individual services and purchases in the online store. By using FlexGenFit services or purchasing products, you accept these T&Cs in full.

 

(b) By accessing or using the Services, you agree to be bound by the Terms. If you do not agree to all of the Terms, you may not access the Site or use the Services. Please read these Terms carefully before accessing our Site or using the Services or purchasing any products. These Terms tell you who we are, how we sell products to you, how you can cancel the contract of sale and what you can do if you have a problem.

 

(c) You represent that you are of legal age and have the legal authority, right and freedom to enter into a binding agreement based on these Terms and to use the Services and purchase Products. If you are a minor, you must have your parent's or legal guardian's permission to use the Services or purchase Products.

2. Membership packages

FlexGenFit offers the following membership packages:

• Silver membership (free of charge):

  • Access to ready-made training plans.

  • Free subscription to the blog.

  • Access to training courses (English videos).

• Gold membership (29.99 €/month):

  • All the benefits of Silver membership.

  • Personalized nutrition and supplement plan.

  • Individually adapted training plan.

  • Bi-weekly adjustments by e-mail.

• Platinum membership (49.99 €/month):

  • All the benefits of Gold membership.

  • Access to the exclusive FlexGenFit app:

    • Progress tracking.

    • Upload progress pictures and weight data.

    • Weekly updated nutrition and training plans.

    • Direct contact with the coach, 7 days a week.

  • Weekly adjustments via the app.

 

3. Online store conditions

FlexGenFit operates an online store with products such as clothing, accessories and fitness-related items.

a) The purchase of products is subject to the conditions applicable at the time.

(b) If you purchase a Product: (i) you are responsible for reading the Product description in full before making a binding purchase; and (ii) the completion of an order on the Site (by completing a payment transaction via the “Order for a Fee” or similar “Order for a Fee” button) may constitute a legally binding contract for the purchase of the relevant Product, unless these Terms provide otherwise.

(c) You can select products from our product selection and add them to your shopping cart by clicking on the corresponding button. Our prices are listed on the site. We reserve the right to change our prices at any time and to correct unintentional pricing errors. These changes will not affect the price of products that you have already purchased. During checkout, you will be shown an overview of all the products you have placed in your shopping cart. The overview includes the main features of each product as well as the total price for all products, the applicable value added tax (VAT) and, if applicable, the shipping costs. On the payment page, you also have the option of checking the products and quantities and, if necessary, changing, removing or correcting them. You can also use the edit function to identify and correct any input errors before placing your final binding order. All stated delivery times apply from receipt of your payment of the purchase price. When you click on the “Place order” button, you place a binding order to purchase the products listed at the price and shipping costs indicated. To complete the order process by clicking on the “Order with costs” button, you must first accept these terms and conditions as legally binding for your order by clicking on the corresponding box.

(d) We will then send you a confirmation of receipt of your order by e-mail, in which your order is listed again and which you can then print or save using the corresponding function. Please note that this is an automatic notification which only confirms that we have received your order. It does not indicate that we have accepted your order.

(e) The legally binding agreement on the purchase of the products is only concluded when we send you a declaration of acceptance by e-mail or dispatch the products to you. We reserve the right not to accept your order. This does not apply in cases in which we offer a payment method - and you select this payment method for your order - in which a payment process is initiated immediately upon transmission of your order (e.g. electronic transfer or real-time transfer via PayPal, Giropay, Paydirekt). In this case, the legally binding agreement is deemed to have been concluded when you have initiated the order process as described above by clicking the “Order with costs” button.

(f) The purchase contract can be concluded in English. After conclusion of the contract, the terms and conditions will be stored by us, you will no longer have access to them.

• Prices and availability:
  Prices are quoted in euros (€) and include VAT unless otherwise stated. The availability of products may vary without prior notice.

• Ordering process:
  Orders are placed via the FlexGenFit website. Upon completion of the order, customers will receive a confirmation email with the details of the purchase.

• Shipping:
  Products will be shipped to the address provided during the checkout process. Shipping costs and estimated delivery times are displayed at the time of purchase. FlexGenFit assumes no liability for delays caused by shipping carriers or customs.

• Returns and Refunds:
  Customers may return unused products in their original condition within 14 days of receipt for a full refund (excluding shipping costs). The cost of return shipping is the responsibility of the customer unless the product is defective or was shipped incorrectly.

 

4. Benifits

Membership benefits include services such as training plans, nutritional advice and progress tracking. The exact details are described in the respective packages. FlexGenFit reserves the right to adjust service offers.

 

5. Booking and payment

• Membership fees are invoiced monthly.

• Payments for store orders and services are processed securely via the accepted payment methods.

• Individual services can be booked independently of membership at the prices indicated.

 

6. Cancellation conditions

• Memberships can be terminated at any time with a notice period of 14 days before the start of the next billing period.

• Booked individual appointments can be canceled up to 24 hours before the scheduled appointment.

• Store orders can only be canceled before the goods are shipped.

7. Liability

FlexGenFit is not liable for injuries, health complications or damages caused by improper use of the programs, failure to follow the instructions provided or incorrect use of purchased products. Customers are advised to consult a doctor or specialist if necessary.

8. Data protection

FlexGenFit complies with the requirements of the applicable data protection laws, in particular the GDPR. Personal data is used exclusively for the provision of services and the processing of orders. Further details can be found in our privacy policy.

 

9. Changes to the GTC

FlexGenFit reserves the right to amend these GTC at any time. Members and customers will be informed of significant changes in good time.

 

10. Place of jurisdiction and applicable law

These GTC are subject to the law of the Federal Republic of Germany. The place of jurisdiction is the registered office of FlexGenFit.

11. Contract in English

The contract can be concluded in English. Once the contract has been concluded, the terms and conditions will be stored by us and you will no longer have access to them.
